What is Aggravated DUI?

An aggravated DUI case can arise in a number of circumstances. Under A.R.S. 28-1383, the offense is defined as driving under the influence (or extreme influence) of alcohol or drugs, when that offense:

  • Is committed while your driver’s license is suspended or restricted for a prior DUI or for certain specific crimes involving a motor vehicle;
  • Is your third or subsequent DUI within a period of eighty-four months;
  • Is committed while there is a minor passenger under the age of fifteen in the vehicle; or
  • Is committed while you are subject to a court order requiring that your vehicle be equipped with an ignition interlock device.

Aggravated DUI is a class 4 felony, unless the charge is for having a minor passenger in your vehicle, in which case it is a class 6 felony. A first-time class 4 felony conviction carries a presumptive sentence of 2.5 years; the presumptive sentence for a class 6 felony is six months.

In addition to potential prison time, and the fines, license suspension, and other consequences of any DUI, a conviction for aggravated driving under the influence subjects a defendant to further penalties. These include (depending upon the specifics of the offense) minimum terms of incarceration; alcohol or drug screening, license revocation, education and treatment; installation of an ignition interlock device; and added assessments and fines.
